Relocation

In the aftermath of a divorce, moving may be the last thing on some couple’s minds.  However, no matter how immediately it happens, relocation by either (or both) parents may inevitably become an issue.  Economic circumstances, job transfer and cost of living can all factor into a person’s decision to move.  When children are involved, the issue of custody often arises.  Our attorneys are experienced in litigating custody issues.  Hire a team that will get you the outcome you deserve.

In most divorces where custody is relevant, there is often a radius clause, typically 35-50 miles.  Unfortunately, in sole custody situations, the parent with that custody often feels that there is no radius issue and that they may move farther away without the court’s permission.  Under Tropea v. Tropea, this is not true and the court must review and approve all relocation applications, regardless of whether there is sole or split custody.

When you’re thinking of relocating, you may at first be tempted to contact the courts yourself to ask for approval.  Like self-representation, this can be dangerous and turn out to be a big mistake in the final ruling.  You want to show yourself in the best possible light, as a responsible parent, and one of the best ways to prove this to the court is to hire an attorney familiar in custody issues.  It can make all the difference between getting successful verdict and a negative one.   A well-presented case by an attorney is your best line of defense.  At our firm, our attorneys know the nuances of custody issues and have a guaranteed strategy to get you the outcome you want.  To get your custody approval, our attorneys will prove to the courts that your intended relocation is in the best interest of the child and will not interfere, to a detrimental degree, with the non-custodial parent.

At our law firm, we have represented clients who want to relocate and also clients who are contesting a relocation by a former spouse or partner.  We know both sides of the issue and have experience in either direction.  Relocation can turn into a complicated legal issue, so don’t trust the outcome to just anyone.  Call us today at 646-358-4976 and set up an appointment with one of our attorneys.
