Is Child Support Necessary and How is it Determined?

Yes, child support is necessary. In the state of New York, children under the age of 21 are entitled to be supported by their parents, according to their parents’ income and ability. Support is paid to the parent who has physical custody or primary residence of the children by the other parent. The court decides how much child support is paid.

When an order for child support is made, the noncustodial parent is directed to pay the Support Collection Unit (SCU). It is the responsibility of the SCU to collect, track, and disburse child support payments to the custodial parent. Child support orders are reviewed every two years to make sure that the custodial parent is getting the right amount.
