How is Custody, Visitation, and Support Enforced When a Parent Doesn’t Comply?

For minor disagreements, it is advised that parents try to work things out on their own. For clear and persistent violations of the child custody and visitation order, the matter can be brought before the courts. Court-ordered child custody and visitation can be enforced by the courts, and the offending parent could have a suspension of his or her visitation rights.

Federal and New York State laws require the local Child Support Enforcement (CSE) unit to enforce a child support order when the noncustodial parent does not pay. The SCU can enforce child support payments through automatic payroll deductions, from state and federal income tax refunds, lottery winnings, or seizure of assets.
