NYC Divorce Requirements

In order to obtain a divorce in the state of New York, you must meet the residency requirements as follows:

  • Parties were married in New York and one of the parties is a resident of the state when divorce proceedings begin and has been a resident for one continuous year prior to the proceedings, or
  • Parties have resided in New York as husband and wife and one of the parties is a resident of the state when divorce proceedings begin and has been a resident for one continuous year prior to the proceedings, or
  • The cause of the divorce occurred in the state of New York and one of the parties is a resident of the state when divorce proceedings begin and has been a resident for one continuous year prior to the proceedings, or
  • The cause of the divorce occurred in the state of New York and both parties are residents of the state for one continuous year prior to initiation of divorce proceedings, or
  • Either party has been a resident of the state of New York for a period of two continuous years prior to initiation of divorce proceedings.
